Terms & Conditions (instore and online)

By entering the Promotion you confirm that you have read, understood and agreed to these terms and conditions (the ‘Terms and Conditions’).

1. Eligibility:

This promotion is only open to UK residents (excluding Northern Ireland) aged 18 years or over who hold a Co-op membership card (not including temporary membership cards). We may ask the winner to provide proof of age. Employees of the Promoter, its associated companies, agencies and any other person (including Co-op Group employees) who is professionally connected with this Promotion are excluded from entering.  A UK bank account will be required to claim the prize.

2. How to enter:

2.1. To enter in store, purchase any pack of 1664 Bière and scan your Co-op membership card in a Co-operative Group Food store during the Promotion Period. Temporary membership card holders are automatically excluded from this promotion.

2.2 To enter online, participants must purchase any pack of 1664 Bière and fill in their membership card number at checkout during the Promotion Period at https://shop.coop.co.uk.

2.3. Purchase necessary. Only one entry per order (for multiple purchases, you must check out separately for each one).

2.4. Each in-store purchase transaction or online order qualifies for one entry. Entries are limited to one per person, per day for the duration of the Promotional Period. Entries not complying with these Terms and Conditions will be invalid.

3. Promotional Period:

The Promotional period will run from 00:00 UTC+01:00 on 14 August 2024 and will finish on 23:59 UTC+01:00 on 3 September 2024.

4. Prize:

4.1.  The are two prizes available to be won, each consisting of £1,664 cash to be paid directly into the winners’ bank account.  In addition, the Promoter will make two donations, each in the sum of £1,664 (to a total of £3,328) to two registered UK charities of the winners’ choice (‘Donation’)*.

4.2. The prize is as stated and is non-transferable.

4.3.  Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prizes are the responsibility of the winners.

4.4 The charities nominated by the winners to receive the Donation must be UK registered charities, registered with the Charity Commission (in the case of charities based in England or Wales), the Scottish Charity Regulator or the Charity Commission for Northern Ireland.

4.5 The Promoter (by itself or by its Fulfilment Agency acting on its behalf) will carry out due diligence on each charity selected by the winners and reserves the right in its absolute discretion to require the winners to select an alternative charity to receive the Donation for any reason.

5. Winner announcement/prize claim:

5.1. There will be 2 winners in total.

5.2. The winners will be drawn by The Co-op at random via a secure, entirely automated independently verified computer system from all eligible entries. The winners will be notified by The Co-op via email within TWO (2) weeks of the end of the Promotional Period. Co-op will use the address registered on the winners’ Co-op membership account to notify them. The winners may withdraw from the promotion by responding “opt-out” within 48 hours of receiving the notification email.  Co-op will pass the winners’ email address to the Promoter’s Fulfilment Agency via email to organise the prize fulfilment.

5.3. To claim their prize, the winners must respond to the Fulfilment Agency not later than 4 October 2024 providing their bank details for the bank account into which they wish to receive their prize and nominating the charity they wish to receive the Donation. If either winner fails to respond within such timeframe, then their prize will be forfeited and The Co-op shall be entitled to select another winner in accordance with the process described above.

5.4 The prize will be paid using the bank account details provided by the winners within 14 days of the winners providing their bank account details in accordance with paragraph 5.3 above. The Donations will be paid to the winners’ nominated charities within 14 days of the charity passing the Promoter’s due diligence processes.

5.5. If either winner rejects their prize or their entry is in breach of these Terms and Conditions, the prize will be forfeited at the Promoter’s sole discretion and The Co-op shall be entitled to select another winner in accordance with the process described above.

6. Privacy and Data Protection:

6.1. Personal data held by The Co-op for the purposes of managing and administering customer membership cards will be used by the The Co-op for the purposes of drawing and contacting the winners of this promotion in accordance with these Terms and Conditions and in compliance with appliable data protection laws and The Co-op’s privacy policy, which is available here: Privacy notice - Co-op (coop.co.uk).

6.2. If you win a prize, The Co-op will share your name and address with the Promoter’s fulfilment agency XSEM Limited (company number 04654429) whose registered office address is Leigh House, St. Pauls Street, Leeds LS1 2JT (‘Fulfilment Agency’), who will process your personal data for the purposes of fulfilling your prize.

6.3. Additionally, if you win the prize, the Fulfilment Agency will make your name and county available, as a winner, to people requesting that information in accordance with the Terms and Conditions and as required by the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing. If you do not want your name to be made available, please inform the Promoter’s fulfilment agency using the contact details in paragraph 6.9. Note that, if requested to do so, the Fulfilment Agency may, on behalf of the Promoter, still share winners’ details with the Advertising Standards Authority.

6.4. Your personal data will not be shared with or processed by the Promoter.

6.5. These Terms and Conditions are the legal basis for the processing of your personal data by the Fulfilment Agency in connection with this promotion. If your personal data is not provided, it will not be possible to award the prize to you if you win.

6.6. The Fulfilment Agency will not process your personal data for any longer than is required for it to comply with the law or to fulfil its obligations to you and other parties under these Terms and Conditions.  To find out more you can contact the Fulfilment Agency using the contact details in paragraph 6.9.

6.7. Your personal data will not be disclosed or shared with any third party other than those who are engaged to administer the promotion and to fulfil and deliver the prizes, or third parties who request details of the winners of this promotion as described at paragraph 6.3 above. Your personal data may be sent to countries outside of the UK in order to conduct aspects of the promotion (e.g. where fulfilment of the prize happens in another country). Where this occurs, the party responsible will ensure that any transfer happens in accordance with applicable law.

6.8. In accordance with the applicable data protection laws and regulations, you are reminded that you may at any time exercise your rights of access, rectification, deletion, limitation of treatment, opposition to treatment (including a right to require that your personal data is erased), your right to amend your data and right to ask to port (transfer) your data directly to another third party. Please note that if you wish to exercise your right to require that your personal data is erased, this will automatically remove your entry from the promotion and, if you are a winner, will mean that you cannot receive or take up the prize.

6.10. If you believe that your personal data is not being treated in accordance with the law, you have the right to file a complaint with the Information Commission’s Officer (ICO) or other competent authority. You can find more details about the ICO at their website https://ico.org.uk/.

7. General:

7.1. The Promoter reserves the right, in exceptional circumstances, to award an alternative prize of equal or greater value, should the prize (or any element of it) become unavailable for any reason.

7.2. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the prize, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

7.3. The Promoter reserves the right, in its absolute discretion, to verify the winners, including but not limited to, proof of identity and/or age, as required or refuse to award a prize or to withdraw prize entitlement and/or refuse participation in the Promotion where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this Promotion’s entry requirements or otherwise where a participant has gained an unfair advantage in participating in the Promotion or has won using fraudulent means.

7.4. By entering the Promotion, you agree to release the Promoter from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or with the acceptance, possession, attendance at or use of the prize (except death or personal injury caused by the Promoter’s negligence, for fraud, or otherwise as prohibited by law).

7.5. In all aspects of this Promotion the Promoter’s decision is final and no correspondence will be entered into regarding the Promotion.

7.6. If any provision of these Terms and Conditions is held invalid, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

7.7 Co-operative Group Limited is not the Promoter and shall not be liable for any breaches of these terms and conditions by the Promoter

7.8. These Terms and Conditions shall be interpreted and applied on the basis of English law and the courts of England and Wales shall have exclusive jurisdiction.
